This document is a supplement to the general Kiges Privacy Policy and regulates data processing issues specific to the Kiges Talent service — a freelance platform for finding Specialists and performing tasks and projects, located at https://talent.kiges.cc.
1. General Provisions
1.1. This document supplements the general Kiges Privacy Policy and applies in conjunction with it. In case of discrepancies between the documents regarding Kiges Talent, this document prevails.
1.2. Use of the Kiges Talent service implies the User's consent to the terms of this document, the general Kiges Privacy Policy, and the Terms of Use.
1.3. Terms used in this document are applied in the meanings defined in the general Kiges Privacy Policy and the Terms of Use of Kiges Talent.
2. Data Processed within Kiges Talent
2.1. To ensure the functionality of the Kiges Talent service, the following categories of data are processed:
2.1.1. Account data: email address, password (hashed), User's name, profile description, photo, contact details, notification settings.
2.1.2. Specialist profile data: information about qualifications, experience, skills, portfolio, services offered, pricing, availability, ratings, and reviews.
2.1.3. Client profile data: information about the Client, company name (for legal entities), order history, ratings, and reviews.
2.1.4. Order data: order details (Subscription or One-time Project), scope, requirements, deadlines, price, status, correspondence between the Client and the Specialist within the Platform.
2.1.5. Project data: files, materials, deliverables, and other content exchanged between the Client and the Specialist within the Platform in the course of performing a One-time Project.
2.1.6. Payment data: tariff information, payment history, Subscription and Project amounts, Commission, bank card details (processed by the payment provider; Kiges Talent does not store full bank card data), Escrow transaction data.
2.1.7. Communication data: messages, files, and other correspondence between Users within the Platform's internal communication tools.
2.1.8. Technical data: IP address, browser information, device information, access time, cookies, usage statistics.
2.2. Kiges Talent does not request or process special categories of personal data (information about health, racial or ethnic origin, political opinions, religious beliefs, etc.), except where the User voluntarily provides such information in their profile or Content, in which case the User bears full responsibility.
2.3. Kiges Talent does not verify the accuracy of the data provided by Users about themselves in their profiles and is not responsible for their reliability.
3. Purposes of Data Processing
3.1. Data is processed for the following purposes:
3.1.1. Registration, authorization, and access to the Platform's features.
3.1.2. Creating and publishing Specialist and Client profiles.
3.1.3. Matching Clients with Specialists, processing orders, and managing Subscriptions and One-time Projects.
3.1.4. Ensuring communication between the Client and the Specialist within the Platform.
3.1.5. Processing payments, holding funds in Escrow, and charging the Commission.
3.1.6. Generating ratings, reviews, and reputation of Users.
3.1.7. Providing technical support and resolving disputes.
3.1.8. Preventing fraud, abuse, and violations of the Terms of Use.
3.1.9. Improving the Platform's functionality and user experience.
3.1.10. Sending notifications, service messages, and (with the User's consent) marketing communications.
4. Profiles and Public Data
4.1. Information placed by the User in their profile may be publicly available to other Platform Users and visitors, unless the User has configured access restrictions.
4.2. Kiges Talent is not liable for the Content placed by the User in their profile, including information about qualifications, experience, portfolio, and services offered.
4.3. The User undertakes not to place in their profile information that violates applicable legislation, the rights of third parties, or the terms of the Terms of Use.
4.4. The User is fully responsible for the accuracy and legality of the information and Content they publish on the Platform.
5. Communication and Project Data
5.1. Correspondence between the Client and the Specialist within the Platform's internal communication tools is stored on the Platform's servers for the purpose of providing the service, resolving disputes, and preventing fraud.
5.2. Files and materials exchanged within the Platform in the course of performing a One-time Project are stored for the period necessary to provide the service and resolve possible disputes.
5.3. Kiges Talent does not verify the content of correspondence and files exchanged between Users and is not responsible for their content, legality, or compliance with the rights of third parties.
5.4. The Operator reserves the right to access correspondence and project data in case of disputes between Users, fraud suspicion, or at the request of authorized state authorities in accordance with the legislation of the Republic of Serbia.
6. Payments and Escrow
6.1. Payment data (bank card number, expiration date, CVV code) is entered by the User directly on the payment provider's side. Kiges Talent does not receive, process, or store full payment data. From the payment provider, Kiges Talent may receive partial (masked) card data, which is displayed in the "Payment Methods" section of Kiges Pay for the purpose of identifying the User's payment method. Such partial data does not allow a payment to be made and cannot be used for unauthorized debiting of funds.
6.2. Kiges Talent processes information about transactions (amount, date, status, order details) for the purpose of providing the service, accounting, and dispute resolution.
6.3. Funds held in Escrow are processed by the payment provider. Kiges Talent does not store Users' funds on its own accounts and does not act as a banking or payment institution.
6.4. Information about payments and Escrow transactions may be provided to authorized state authorities in accordance with the legislation of the Republic of Serbia.
7. Data Storage and Protection
7.1. User data is stored for the period of use of the Platform and for a reasonable period thereafter, except for data that must be stored in accordance with the legislation of the Republic of Serbia.
7.2. Order data, correspondence, and project files are stored for the period necessary to provide the service and resolve possible disputes, after which they are deleted or anonymized.
7.3. Kiges Talent takes technical and organizational measures to protect User data, including encrypting data transmission via HTTPS, restricting employee access to data, and regular backups.
7.4. In the event of a data security breach, Kiges Talent takes measures to eliminate the breach and notifies affected Users within a reasonable time.
7.5. Kiges Talent does not guarantee absolute data security and is not liable for the disclosure of data resulting from circumstances beyond the Operator's control, including hacker attacks, failures of third-party services, or actions of government authorities.
8. Data Sharing with Third Parties
8.1. Kiges Talent does not share Users' personal data with third parties, except in cases provided for by the legislation of the Republic of Serbia.
8.2. Kiges Talent may use the services of third-party providers (payment providers, email sending services, hosting providers, cloud storage providers) to ensure the operation of the service. Data sharing with such providers is carried out under confidentiality agreements.
8.3. Kiges Talent may share aggregated and anonymized statistical data with third parties for the purpose of analysis and service improvement.
8.4. Kiges Talent may share User data with authorized state authorities of the Republic of Serbia on the grounds and in the manner established by the legislation of the Republic of Serbia.
9. User Rights
9.1. The User has the right to:
9.1.1. Request information about the personal data processed by Kiges Talent.
9.1.2. Demand clarification, blocking, or destruction of their personal data if it is incomplete, outdated, inaccurate, or unlawfully obtained.
9.1.3. Withdraw consent to the processing of personal data by sending a notification to info@kiges.cc.
9.1.4. Delete their account and all associated data by contacting support.
9.2. Upon account deletion, Kiges Talent deletes the User's data within a reasonable time, except for data that must be stored in accordance with the legislation of the Republic of Serbia (e.g., transaction data, dispute-related correspondence).
9.3. Withdrawal of consent to data processing may lead to the inability to use the Platform's features.
10. Data Deletion
10.1. The User can delete their profile data, order history, and project files at any time through the Platform's interface or by contacting support.
10.2. When an account is deleted, all associated data, including profile, portfolio, order history, and correspondence, is deleted without the possibility of recovery, except for data subject to mandatory storage by law.
10.3. Kiges Talent reserves the right to delete data of inactive accounts after 12 (twelve) months from the date of the User's last activity.
10.4. The Operator is not liable for any losses of the User arising from the deletion of data, including loss of project files, correspondence, or portfolio.
11. Cookies and Analytics
11.1. Kiges Talent uses cookies to ensure the operation of authorization and remember User settings.
11.2. Kiges Talent may collect aggregated anonymous statistics on Platform usage to improve the service.
11.3. Disabling cookies may result in the inability to access parts of the Platform that require authorization.
12. Additional Conditions
12.1. Kiges Talent reserves the right to make changes to this document. The User undertakes to independently monitor the current version.
