This document is a supplement to the general Kiges Privacy Policy and regulates data processing issues specific to the Kiges Development service — a platform for ordering the development of digital solutions (websites, landing pages, bots, mobile applications, and related services), located at https://web.kiges.cc.
1. General Provisions
1.1. This document supplements the general Kiges Privacy Policy and applies in conjunction with it. In case of discrepancies between the documents regarding Kiges Development, this document prevails.
1.2. Use of the Kiges Development service implies the User's consent to the terms of this document and the general Kiges Privacy Policy.
1.3. Terms used in this document are applied in the meanings defined in the general Kiges Privacy Policy and the Public Offer.
2. Data Processed within Kiges Development
2.1. To ensure the functionality of the Kiges Development service, the following categories of data are processed:
2.1.1. Account data: email address, password (hashed), User's name, notification settings.
2.1.2. Order data: type of service ordered (landing page, business card website, multi-page website, Telegram bot, VK bot, mobile application, additional services), technical specification, answers to order form questions, order status, cost and payment stage information.
2.1.3. Materials data: texts, images, logos, brand elements, files, documents, access credentials, and other materials uploaded by the User for order fulfillment.
2.1.4. Communication data: correspondence with the Contractor and support service, comments and revision requests within the order management panel.
2.1.5. Payment data: tariff information, payment history, bank card details (processed by the payment provider; Kiges Development does not store full payment data). From the payment provider, Kiges Development may receive partial (masked) card data, which is displayed in the "Payment Methods" section of Kiges Pay for the purpose of identifying the User's payment method. Such partial data does not allow a payment to be made and cannot be used for unauthorized debiting of funds.
2.1.6. Delivery data: links to demo versions of the result, final files, deployed products, hosting and domain configuration data (if hosting or deployment is ordered as an additional service).
2.1.7. Technical data: IP address, browser information, access time, cookies, server logs.
2.2. Kiges Development does not request or process special categories of personal data (information about health, racial or ethnic origin, political opinions, religious beliefs, etc.).
2.3. Kiges Development does not verify the accuracy of the data provided by Users about themselves and is not responsible for their reliability.
3. Purposes of Data Processing
3.1. Data is processed for the following purposes:
3.1.1. Formation and approval of technical specifications and order processing.
3.1.2. Development of the ordered digital solutions (websites, bots, mobile applications) and provision of additional services.
3.1.3. Providing access to the order management panel and the ability to track development progress.
3.1.4. Delivery of work results, demo versions, and final files.
3.1.5. Ensuring User authorization and access to service features.
3.1.6. Invoicing and payment processing (prepayment and final payment).
3.1.7. Providing technical support.
3.1.8. Preventing abuse, fraud, and violations of the Public Offer.
3.1.9. Sending notifications to the User about order status, service status, and account.
4. Order Materials and User Content
4.1. The User bears SOLE and FULL responsibility for all materials provided in the technical specification and uploaded for order fulfillment, including their legality, accuracy, and compliance with the rights of third parties.
4.2. The User confirms that they hold the necessary rights to the provided materials (texts, images, logos, trademarks, and other objects of intellectual property). Kiges Development is not liable for claims by third parties related to materials provided by the User.
4.3. Access credentials provided by the User (hosting access, domain registrar access, API keys, bot tokens, and similar) are used exclusively for order fulfillment. The User is recommended to change such credentials after completion of the works.
4.4. Kiges Development is not liable for the content of materials provided by the User and incorporated into the delivered product.
5. Developed Products and Third-Party Services
5.1. Developed digital products may operate on third-party platforms and services (hosting providers, domain registrars, Telegram, VK, application stores). The processing of data by such platforms is governed by their own policies.
5.2. Kiges Development is not responsible for the operation or data processing of third-party platforms on which the delivered product operates after its acceptance by the User.
5.3. If the ordered product collects personal data of end users (feedback forms, bots, mobile applications), the User acts as the data controller for such data and bears full responsibility for compliance with data protection legislation (GDPR, CCPA, and equivalent legislation) regarding end users of the product.
5.4. If hosting or deployment of the product is ordered as an additional service, server configuration data, domain data, and SSL certificate information are processed to provide such service. After the product is transferred to the User, responsibility for its operation passes to the User.
6. Data Storage and Protection
6.1. Order data, technical specifications, and materials are stored for the period of use of the Service and for a reasonable period thereafter, except for data that must be stored in accordance with applicable legislation.
6.2. Kiges Development takes technical and organizational measures to protect User data, including encrypting data transmission via HTTPS, restricting employee access to data, and regular backups.
6.3. Access to the User's materials and order data is granted only to the specialists involved in the order fulfillment.
6.4. In the event of a data security breach, Kiges Development takes measures to eliminate the breach and notifies affected Users within a reasonable time.
6.5. Kiges Development does not guarantee absolute data security and is not liable for the disclosure of data resulting from circumstances beyond the Contractor's control, including hacker attacks, failures of third-party services, or actions of government authorities.
7. Data Sharing with Third Parties
7.1. Kiges Development does not share Users' personal data with third parties, except in cases provided for by the legislation of the Republic of Serbia.
7.2. Kiges Development may use the services of third-party providers (payment providers, hosting providers, email sending services, platform APIs required for the development and delivery of the product) to ensure the operation of the service. Data sharing with such providers is carried out under confidentiality agreements.
7.3. Kiges Development may share aggregated and anonymized statistical data with third parties for the purpose of analysis and service improvement.
7.4. Kiges Development may share User data with authorized state authorities of the Republic of Serbia on the grounds and in the manner established by the legislation of the Republic of Serbia.
7.5. The User's materials and technical specification may be accessible to subcontractors involved in the order fulfillment, who are bound by confidentiality obligations.
8. User Rights
8.1. The User has the right to:
8.1.1. Request information about the personal data processed by Kiges Development.
8.1.2. Demand clarification, blocking, or destruction of their personal data if it is incomplete, outdated, inaccurate, or unlawfully obtained.
8.1.3. Withdraw consent to the processing of personal data by sending a notification to info@kiges.cc.
8.1.4. Delete their account and all associated data by contacting support.
8.2. Upon account deletion, Kiges Development deletes the User's data within a reasonable time, except for data that must be stored in accordance with applicable legislation (e.g., transaction data, abuse prevention logs).
8.3. Withdrawal of consent or deletion of data may result in the impossibility of fulfilling the current order. In this case, the terms of the Public Offer regarding payments already made apply.
9. Data Deletion
9.1. The User can delete their materials and order data at any time through the service interface or by contacting support.
9.2. When an account is deleted, all associated data, including orders, technical specifications, materials, and correspondence, is deleted without the possibility of recovery, except for data subject to mandatory storage by law.
9.3. Kiges Development reserves the right to delete data of inactive accounts after 12 (twelve) months from the date of the User's last activity.
9.4. The Contractor is not liable for any losses of the User arising from the deletion of data, including loss of orders, materials, or delivered files.
10. Cookies and Analytics
10.1. Kiges Development uses cookies to ensure the operation of authorization and remember User settings.
10.2. Kiges Development may collect aggregated anonymous statistics on service usage to improve the service.
10.3. Disabling cookies may result in the inability to access parts of the service that require authorization.
11. Additional Conditions
11.1. Kiges Development reserves the right to make changes to this document. The User undertakes to independently monitor the current version.
