This Privacy Policy regarding personal data (hereinafter – Privacy Policy) applies to all information that the website kiges (hereinafter – SITE), located at the domain name kiges.cc (and its subdomains), may obtain about the User during the use of the website kiges.cc (and its subdomains), its programs and products.
1. Definition of Terms
1.1. The following terms are used in this Privacy Policy:
1.1.1. "Site Administration" (hereinafter – Administration) – authorized employees managing the website kiges, who organize and/or carry out the processing of personal data, and also determine the purposes of processing personal data, the composition of personal data subject to processing, and the actions (operations) performed with personal data.
1.1.2. "Personal data" – any information relating to a directly or indirectly identified or identifiable natural person (subject of personal data).
1.1.3. "Processing of personal data" – any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.
1.1.4. "Confidentiality of personal data" – a mandatory requirement for the Operator or any other person who has gained access to personal data not to allow their distribution without the consent of the subject of personal data or the existence of another legal basis.
1.1.5. "Website kiges" – a set of interrelated web pages hosted on the Internet at a unique address (URL): kiges.cc, and its subdomains.
1.1.6. "Subdomains" – pages or sets of pages located on third-level domains belonging to the website kiges, as well as other temporary pages at the bottom of which the contact information of the Administration is indicated.
1.1.7. "User of the website kiges" (hereinafter – User) – a person who has access to the website kiges via the Internet and uses the information, materials and products of the website kiges.
1.1.8. "Cookies" – a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request each time an attempt is made to open a page of the corresponding website.
1.1.9. "IP address" – a unique network address of a node in a computer network through which the User gains access to kiges.
2. General Provisions
2.1. Use of the website kiges by the User implies consent with this Privacy Policy and the conditions for processing the User's personal data.
2.2. In case of disagreement with the conditions of the Privacy Policy, the User must cease using the website kiges.
2.3. This Privacy Policy applies to the website kiges. kiges does not control and is not responsible for third-party websites to which the User may navigate via links available on the website kiges.
2.4. The Administration does not verify the accuracy of the personal data provided by the User.
3. Subject of the Privacy Policy
3.1. This Privacy Policy establishes the obligations of the Administration regarding non-disclosure and ensuring the protection regime of the confidentiality of personal data that the User provides upon request of the Administration during registration on the website kiges or when subscribing to the informational email newsletter.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out forms on the website kiges and includes the following information: 3.2.1. surname, first name, patronymic of the User; 3.2.2. contact phone number of the User; 3.2.3. email address; 3.2.4. place of residence of the User (if necessary); 3.2.5. photograph (if necessary).
3.3. kiges protects Data that is automatically transmitted when visiting pages: – IP address; – information from cookies; – browser information; – access time; – referrer (address of the previous page).
3.3.1. Disabling cookies may result in the inability to access parts of the site that require authorization.
3.3.2. kiges collects statistics on the IP addresses of its visitors. This information is used for the purpose of preventing, detecting and solving technical problems.
3.4. Any other personal information not specified above (browsing history, browsers used, operating systems, etc.) is subject to reliable storage and non-distribution, except for cases provided for in clause 5.2 of this Privacy Policy.
4. Purposes of Collecting User's Personal Information
4.1. The Administration may use the User's personal data for the following purposes:
4.1.1. Identification of the User registered on the website kiges for further authorization.
4.1.2. Providing the User with access to personalized data of the website kiges.
4.1.3. Establishing feedback with the User, including sending notifications, requests regarding the use of the website kiges, processing requests and applications from the User.
4.1.4. Determining the User's location for security purposes and fraud prevention.
4.1.5. Confirming the accuracy and completeness of the personal data provided by the User.
4.1.6. Creating an account for using parts of the website kiges, if the User has given consent to create an account.
4.1.7. Notifying the User by email.
4.1.8. Providing the User with effective technical support in case of problems related to the use of the website kiges.
4.1.9. Providing the User, with their consent, with special offers, newsletters and other information on behalf of the website kiges.
5. Methods and Terms of Processing Personal Information
5.1. Processing of the User's personal data is carried out without a time limit, by any legal method, including in personal data information systems using automation tools or without such tools.
5.2. The User's personal data may be transferred to authorized state authorities of the Republic of Serbia only on the grounds and in the manner established by the legislation of the Republic of Serbia.
5.3. In the event of loss or disclosure of personal data, the Administration has the right not to inform the User about the loss or disclosure of personal data.
5.4. The Administration takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.
5.5. The Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
6. Rights and Obligations of the Parties
6.1. The User has the right to:
6.1.1. Make a free decision to provide their personal data necessary for using the website kiges, and give consent for their processing.
6.1.2. Update and supplement the provided information about personal data in case of changes to such information.
6.1.3. The User has the right to receive from the Administration information concerning the processing of their personal data, if such right is not limited in accordance with the laws of the Republic of Serbia. The User has the right to demand from the Administration clarification of their personal data, its blocking or destruction if the personal data is incomplete, outdated, inaccurate, unlawfully obtained or not necessary for the stated purpose of processing, as well as to take measures provided by law to protect their rights. To do this, it is sufficient to notify the Administration at the specified email address.
6.2. The Administration is obliged to:
6.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.
6.2.2. Ensure the storage of confidential information in secret, not disclose it without the prior written permission of the User, and also not to sell, exchange, publish, or disclose by other possible means the transmitted personal data of the User, except as provided in clause 5.2 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data according to the procedure commonly used to protect such information in the current business practice.
6.2.4. Block personal data relating to the respective User from the moment of the User's appeal or request, or their legal representative or authorized body for the protection of the rights of personal data subjects, for the period of verification, in case of revealing unreliable personal data or unlawful actions.
7. Liability of the Parties
7.1. The Administration is not liable for any losses incurred by the User in connection with the use or inability to use the website kiges, including, but not limited to, losses caused by the loss, disclosure or unlawful use of personal data, except in cases of intentional harm caused by the Administration. The Administration does not compensate the User for lost profits, data loss, loss of income or other indirect losses.
7.2. In the event of loss or disclosure of Confidential Information, the Administration is not liable if such confidential information:
7.2.1. Became public knowledge before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Administration of the Resource.
7.2.3. Was disclosed with the consent of the User.
7.3. The User bears full responsibility for compliance with the requirements of the legislation of the Republic of Serbia, including laws on advertising, on the protection of copyright and related rights, on the protection of trademarks and service marks, but not limited to the above, including full responsibility for the content and form of materials.
7.4. The User acknowledges that responsibility for any information (including, but not limited to: data files, texts, etc.) to which they may have access as part of the website kiges, is borne by the person who provided such information.
7.5. The User agrees that the information provided to them as part of the website kiges may be an object of intellectual property, the rights to which are protected and belong to other Users, partners or advertisers who place such information on the website kiges. The User has no right to modify, lease, lend, sell, distribute or create derivative works based on such Content (in whole or in part), except when such actions have been expressly authorized in writing by the owners of such Content in accordance with the terms of a separate agreement.
7.6. In relation to textual materials (articles, publications available in free public access on the website kiges), their distribution is permitted provided that a link to kiges is given.
7.7. The Administration is not liable to the User for any loss or damage incurred by the User as a result of deletion, failure or inability to save any Content and other communication data contained on the website kiges or transmitted through it.
7.8. The Administration is not liable for any direct or indirect losses arising from: use or inability to use the website or individual services; unauthorized access to the User's communications; statements or behavior of any third party on the website; force majeure circumstances, including Internet network failures, hacker actions, virus attacks, equipment and software failures, actions of government authorities, as well as other circumstances beyond the Administration's control.
7.9. The Administration is not responsible for any information posted by the User on the website kiges, including, but not limited to: information protected by copyright, without the direct consent of the copyright holder.
7.10. The aggregate liability of the Administration to the User for any claims arising from the use of the website kiges is limited to the amount of the last payment actually made by the User for the use of the services of the website kiges. The Administration is not liable for any amounts exceeding the specified limit.
7.11. The User undertakes to compensate the Administration for all losses caused by violation of this Privacy Policy, the terms of the Public Offer or current legislation, including legal and representation costs.
8. Dispute Resolution
8.1. All disputes and disagreements arising from the relationship between the User and the Administration shall be resolved exclusively through pre-trial proceedings by correspondence via email.
8.2. A User with a claim must send it in writing or electronically to the Administration's email address, describing the essence of the claim and the proposed method of resolution.
8.3. The Administration, within 30 (thirty) calendar days from the date of receipt of the claim, notifies the User in writing or electronically of the results of the claim review.
8.4. The parties undertake to make all reasonable efforts to reach an agreement through pre-trial proceedings. The User agrees not to go to court and not to initiate legal proceedings regarding disputes arising from the use of the website kiges, and to resolve all disputed matters through email correspondence.
8.5. The current legislation of the Republic of Serbia applies to this Privacy Policy and the relations between the User and the Administration.
9. Additional Conditions
9.1. The Administration has the right to make changes to this Privacy Policy without the User's consent.
9.2. The new Privacy Policy takes effect from the moment it is posted on the website kiges.cc, unless otherwise provided by the new version of the Privacy Policy.
